US Pauses AI Diffusion Regulations and Tightens Chip Export Restrictions
The Department of Commerce (DOC) has halted the implementation of the previously anticipated “AI Diffusion Rule” just one day before its compliance deadline of May 15th. This rule, initially designed during the Biden administration, aimed to regulate the flow of advanced AI technology from the United States, but officials have decided it would complicate innovation and harm international relations.
According to the DOC, the rule would impose "burdensome new regulatory requirements" on tech companies and potentially "downgrade" many nations, affecting America’s relationships with them. Consequently, the Bureau of Industry and Security (BIS) will publish a notice in the Federal Register to rescind this rule, with the prospect of creating a new framework in the future.
Jeffery Kessler, the Under Secretary of Commerce for Industry and Security, has directed enforcement teams to pause actions regarding the now-defunct rule and highlighted a commitment to pursuing an inclusive strategy for American AI technology in collaboration with trusted allies while preventing adversaries from gaining access.
What Was the AI Diffusion Rule?
The AI Diffusion Rule represented an effort by the Biden administration to control the export of advanced US technology, including AI chips and related cloud services, with the intention of maintaining the US’s leadership in AI while safeguarding national security. It proposed a three-tier categorization for countries regarding access to high-performance AI technologies:
- Tier 1: Close allies like Japan and South Korea would see minimal restrictions.

The regulation also included caps on the quantity of advanced chips imported by various nations and sought to regulate the export of classified AI model weights, which are vital to AI systems. The overarching goal was to use access to American tech as leverage to encourage compliance with US standards among other nations.
While intended to counter Chinese advancements, the rule saw significant backlash from major US tech companies such as Nvidia and Microsoft, who argued it would lead to decreased competitiveness and innovation. Many countries expressed dissatisfaction with being categorized as second-tier, fearing it might push them towards sourcing AI technologies from other regions, including China.

In addition to canceling the AI Diffusion Rule, the BIS announced stricter measures for semiconductor exports to ensure American technologies remain protected.
