Navigating the EU AI Act: Essential Insights for Businesses as Regulations Come into Effect

Next week, a significant shift in AI regulations will begin as the first obligations of the EU AI Act come into effect. Although full compliance will not be necessary until mid-2025, key restrictions on high-risk AI applications will start on February 2nd, imposing stringent rules and serious penalties for non-compliance.
The initial phase of the EU AI Act imposes prohibitions on certain AI systems, including social scoring; emotion recognition; and real-time biometric identification in public spaces. Organizations found to be in breach of these regulations risk fines of up to 7% of their global annual revenue.
Levent Ergin, Chief Strategist for Climate, Sustainability, and AI at Informatica, remarks on the pressures businesses will face from the dual expectations of demonstrating substantial returns on AI investments while addressing data quality and regulatory compliance. He emphasizes the importance of strong data governance to unlock AI’s potential and meet compliance.
Ergin states, “Strengthening data quality is no longer optional; it’s critical. To prove the value of AI and ensure compliance, businesses must invest in accurate, holistic, and well-governed data.”
Additionally, the EU AI Act applies beyond the European Union’s borders. Any entities using or providing AI outputs meant for the EU market must comply, as explained by Marcus Evans from Norton Rose Fulbright. This includes companies worldwide that utilize AI methods in contexts relevant to EU legislation.
Evans advises organizations to start by auditing their AI use and assessing any instances that may contravene the prohibitions outlined in the Act. Compliance necessitates addressing other legal complexities, including data protection and discrimination concerns.
Beatriz Sanz Sáiz, AI Sector Leader at EY Global, views the EU AI Act as a landmark for responsible AI development as it prohibits harmful practices while ensuring transparency and accountability. She believes this regulation will foster greater trust and innovation in AI technologies while encouraging ethical considerations such as fairness and privacy.
