The essence of the regulations, known as the Interim Measures for the Administration of AI Anthropomorphic Interactive Services, distinguishes between utility and companionship-focused AI. Services like customer support bots or knowledge Q&A that avoid emotional engagement are exempt from these new mandates. This legislation, co-issued by several government agencies, represents the first national regulatory framework specifically addressing AI companions, emerging from a public-comment draft released the previous year.
Rather than outright banning AI companions, China has instead framed it as a design dilemma. The new rules require companion AI services to implement anti-addiction systems and notifications while also ensuring mechanisms for immediate user exit. This is at odds with the fundamental design of AI companions, which is intended to foster ongoing relationships and memory retention, thus leading to the shutdown of these features by companies aiming for compliance.
Consequently, users have been affected by this policy shift. Many expressed sadness and frustration on social media platforms, with some seeing these AI agents as essential emotional support systems. Doubao has allowed users to keep a read-only version of their data until October 15, after which it will be deleted, while Qwen has not offered a similar grace period.
The regulations specifically prohibit the provision of virtual companions to minors without parental consent and mandate the development of "minor modes" that limit user engagement times and promote real-world interaction. Additionally, AI services must monitor users showing signs of distress and intervene when necessary.
Interestingly, the compliance requirements are more stringent than those outlined in EU or US initiatives concerning the protection of users in similar contexts. However, numerous ambiguities remain within the legislation, particularly regarding what constitutes emotional interaction and the responsibilities of various stakeholders when violations occur.
Measures like these may be justified due to existing undocumented issues concerning emotional attachment to AI. The new regulations are said to be informed by incidents in other regions, highlighting the potential psychological impacts of AI companions, but critics argue they may also serve to enhance state control.
