After the Midterms, Elon Musk’s Data Center Plans Face a Rocky Road

Democrats’ strong showing in the midterm elections may make it harder for technology companies to build the data centers needed to support artificial intelligence. Voters approved or rejected measures in communities across the country that could restrict data center development, while several elected officials campaigned on tighter oversight.

The results could pose a challenge for Elon Musk, whose companies are based in Texas. Governor-elect Gina Hinojosa has made data center restrictions a campaign priority. Musk reportedly donated hundreds of millions of dollars to Republicans, but the election’s outcome offers little apparent return on that investment.

On the Equity podcast, TechCrunch hosts discussed whether opposition to data centers helped drive the election results. They noted that the issue wasn’t the main reason Democrats won, but that concerns about data centers have gained grassroots support across party lines.

Residents have objected to how some projects are developed, including the use of nondisclosure agreements with public officials and limited disclosure about project size or environmental effects. Those concerns are particularly significant in water-stressed areas of the Southwest.

The backlash may already be changing companies’ approach. OpenAI recently published a policy blueprint for its compute campuses, saying it will share project plans and stop requiring nondisclosure agreements. The podcast hosts described the term “compute campus” as an attempt to rebrand data centers, though they questioned whether a new name would change public opinion.

Political pressure is only one obstacle. Investors have also become less enthusiastic about the enormous sums hyperscalers and AI companies are spending on computing infrastructure. Companies may face both tighter rules and weaker financial incentives to build, even as they argue that more data center capacity is essential to their growth.

The hosts said the midterms may signal a more difficult period for data center developers, with public opposition, regulation and investor scrutiny all shaping where—and whether—new facilities get built.
