Governor Newsom Signs Landmark AI Safety Bill SB 53: A New Era for Artificial Intelligence Regulation in California

California Governor Gavin Newsom has officially signed SB 53, a groundbreaking bill that introduces unprecedented transparency requirements for large AI companies. This legislation, the first of its kind in the United States, mandates that major AI labs, including OpenAI, Anthropic, Meta, and Google DeepMind, disclose their safety protocols.

Passed by the state legislature two weeks prior, SB 53 also provides whistleblower protections for employees working within these organizations. Furthermore, the bill establishes a process for AI companies and the public to report potential critical safety incidents to California’s Office of Emergency Services. AI firms are now required to report incidents related to crimes executed without human oversight, such as cyberattacks, as well as deceptive actions by AI models that are not covered under the EU AI Act.

Reactions to the bill have been mixed across the AI sector. Many tech firms caution that state-level regulations may lead to a fragmented legal landscape that could stifle innovation. In contrast, Anthropic publicly endorsed the legislation, while Meta and OpenAI expressed opposition, with OpenAI going as far as to issue an open letter urging Governor Newsom not to sign SB 53.

As this legislation unfolds, it comes at a time when top-tier Silicon Valley leaders have invested millions into super PACs aimed at supporting candidates who advocate for minimal AI regulation. Notable figures from OpenAI and Meta have launched initiatives to influence policy in favor of the AI industry.

Other states are likely to observe California’s actions with keen interest as they develop their own strategies to address the challenges posed by rapid advancements in AI technology. For instance, New York is currently considering a similar bill that awaits the signature of Governor Kathy Hochul.

In a statement, Newsom emphasized the potential of the AI industry while assuring that regulations can offer vital community protection. He stated, “This legislation strikes that balance. AI is the new frontier in innovation, and California is not only here for it – but stands strong as a national leader by enacting the first-in-the-nation frontier AI safety legislation that builds public trust as this emerging technology rapidly evolves.”

Governor Newsom is also contemplating another significant bill, SB 243, which aims to regulate AI companion chatbots by enforcing safety measures and accountability.

Senator Scott Wiener, who authored SB 53, had previously attempted to introduce a more comprehensive bill last year, which was vetoed by Newsom amid considerable resistance from the tech community. This time, he has taken measures to engage with major AI corporations to refine the bill and address their concerns.
