India Abandons Predetermined Approval Requirement for AI Model Launches
India is reconsidering a recent AI guideline following backlash from numerous native and international entrepreneurs and investors.
The Ministry of Electronics and IT issued an updated AI guideline to industry participants on Friday, no longer mandating them to acquire governmental permission prior to releasing or applying an AI model to consumers in the South Asian market.
As per the modified rules, companies are now recommended to tag AI models that are under-tested and unreliable, informing users about their potential errors or inconsistency.
This modification comes after the IT ministry of India received strong criticism earlier this month from several prominent individuals. Martin Casado, a partner at venture firm Andreessen Horowitz, described India’s initial action as “a travesty.”
The advisory on March 1 marked a change in India’s prior stance of non-interference in regards to AI regulation. Not even a year prior, the ministry had decided against the regulation of AI growth, identifying the sector as a key player in India’s strategic interests.
The new advisory, just like the one issued earlier this month, has not been made available online, but TechCrunch has managed to review a copy of it.
Earlier this month, the ministry communicated that although the advisory was not legally binding, it indicated the “future of regulation” and that the government did mandate compliance.
The advisory underscores that AI models must not be employed to disseminate illegal content as per Indian law and should not validate bias, discrimination, or possible threats to the electoral process’s integrity. Intermediaries are also counseled to utilize “consent pop-ups” or comparable mechanisms to expressly notify users about the unreliability of AI-generated content.
The ministry has maintained its focus on making sure that deepfakes and false information can be easily identified. They’ve recommended that intermediaries mark or incorporate content with unique metadata or identifiers. They’ve stopped requiring companies to create a method to identify the “originator” of any given message.
