Penguin Random House Takes a Stand: Protecting Books from AI Training Exploitation

Penguin Random House (PRH) has made a notable move in response to growing worries regarding the use of intellectual property for training AI systems.
The publisher has implemented a new statement on the copyright pages of its newly published and reprinted books, which reads, “No part of this book may be used or reproduced in any manner for the purpose of training artificial intelligence technologies or systems.” This update is enhanced by a clause that removes PRH’s works from the European Union’s text and data mining exception, consistent with relevant copyright laws.
By being among the first prominent publishers to address the AI training issue directly, PRH is engaging in the larger conversation about how technology companies leverage copyrighted material to develop large language models (LLMs), which power chatbots and various AI applications. In recent years, publishers have become increasingly worried about the potential misuse of their intellectual property, particularly following reports that AI companies have used copyrighted books to refine their technologies.
Penguin Random House (PRH) has initiated changes to its copyright page, aiming to safeguard its content preemptively, even though these modifications do not alter the existing legal framework surrounding copyright. These clauses function similarly to a “robots.txt” file, which websites utilize to request that their content not be harvested by bots or AI technologies. Although these notifications reflect the publisher’s intent, they hold no legal authority, since existing copyright protections remain intact without such disclaimers.
This action by PRH highlights the ongoing friction between content creators and the artificial intelligence sector, as an increasing number of authors, publishers, and other creatives are advocating for more robust protections. The Authors’ Licensing and Collecting Society (ALCS) has voiced strong support for PRH’s efforts. ALCS CEO Barbara Hayes has praised the updated copyright language, underscoring the necessity for publishers to shield their works from unauthorized exploitation in AI training.
Nonetheless, some argue that merely modifying copyright pages may not suffice. While the Society of Authors (SoA) commends PRH’s intentions, it believes that further steps are essential to ensure authors’ rights are adequately upheld. SoA CEO Anna Ganley has urged publishers to move beyond these declarations and implement explicit safeguards in author contracts, ensuring that writers are notified before their work is employed in AI-related projects.
As artificial intelligence continues to evolve, the discussion surrounding its use of copyrighted material is far from settled. PRH’s recent action might signal a broader transformation within the publishing industry, but the responses from other publishers and the legal framework will ultimately determine its impact.
