The EU AI Act is scheduled to be fully implemented in August 2026, although certain provisions will take effect ahead of that date.

This legislation introduces an unprecedented regulatory framework for AI systems, utilizing a risk-based approach that classifies AI applications according to their potential effect on safety, human rights, and overall societal welfare.

“Certain systems are completely prohibited, while those classified as ‘high-risk’ must comply with more rigorous requirements and evaluations prior to deployment,” states the DPO Centre, a consultancy focused on data protection.

In a manner similar to GDPR, the Act extends its jurisdiction to any organization that markets, deploys, or utilizes AI systems within the EU, irrespective of where the system originates. Organizations will be primarily categorized as ‘Providers’ or ‘Deployers,’ with further classifications for ‘Distributors,’ ‘Importers,’ ‘Product Manufacturers,’ and ‘Authorised Representatives.’

For those organizations that are developing or deploying AI systems, especially those labeled as high-risk, the process of ensuring compliance is expected to be intricate. Nonetheless, experts advise viewing this as an opportunity instead of a challenge.

“By adopting compliance as a driving force for enhancing transparency in AI deployment, companies can transform regulatory expectations into a competitive edge,” remarks the DPO Centre.

Crucial strategies for preparation include thorough training for employees, establishing strong corporate governance frameworks, and integrating robust cybersecurity protocols. The stipulations set forth by the legislation frequently align with the existing GDPR frameworks, particularly in relation to transparency and accountability.

Organizations must prioritize adherence to ethical AI principles while also ensuring there is clear documentation regarding their systems’ functionality, limitations, and intended applications. Currently, the EU is working on developing specific codes of practice and templates to aid in meeting compliance requirements.

For companies that are unclear about their obligations, it is advised to seek professional assistance at the earliest opportunity. Tools such as the EU AI Act Compliance Checker can aid organizations in confirming that their systems are in line with regulatory standards.

Instead of viewing compliance as just a regulatory burden, innovative organizations should consider the EU’s AI Act as a chance to showcase their dedication to responsible AI development and to foster increased trust with their customers.
