EU Unveils Draft Regulatory Guidance for AI Models: What You Need to Know

The European Union has unveiled a draft titled the “First Draft General-Purpose AI Code of Practice,” marking its commitment to formulating comprehensive regulatory guidance for general-purpose AI models. This initiative, driven by input from various sectors, has been steered by four specific Working Groups focused on distinct aspects of AI governance, including transparency, risk identification, and technical risk mitigation.

The draft aligns with existing European laws, like the Charter of Fundamental Rights, and reflects international standards, aiming for proportionality to risks while remaining adaptable to rapid technological advancements.

Key objectives highlighted in the draft include:

  • Defining compliance pathways for AI model providers.
  • Promoting clarity across the AI value chain for AI model integration.
  • Ensuring adherence to copyright laws, particularly concerning their use in training models.
  • Ongoing assessment and mitigation of systemic risks associated with AI.

A significant aspect of the draft is its classification of systemic risks, which encompasses various threats such as cyber challenges, accidental loss of autonomous control, and the potential for widespread misinformation. Recognizing the evolving nature of AI technology, the draft proposes an adaptable framework for risk identification, analysis, and mitigation tailored to a model’s life cycle.

Providers are encouraged to implement processes for identifying and reporting major incidents linked to their AI models and to engage with independent experts for risk assessments—especially for models that represent substantial systemic risks.

The EU AI Act, effective as of August 1, 2024, mandates the completion of this Code by May 1, 2025. This approach emphasizes the EU’s proactive efforts in AI regulation, with a focus on safety, transparency, and responsibility.

Stakeholders will have the opportunity to contribute to the draft, with written feedback accepted until November 28, 2024. The initiative aims to lay down a global benchmark for AI governance, addressing critical issues like transparency, risk management, and copyright compliance to foster innovation while ensuring consumer protection and safeguarding fundamental rights.
