UK Court Issues Stark Warning: Lawyers May Face Severe Penalties for Using Fake AI-Generated Citations

The High Court of England and Wales has issued a warning to lawyers regarding the use of artificial intelligence (AI) in their legal work. In a ruling involving two recent cases, Judge Victoria Sharp stated that generative AI tools, such as ChatGPT, are not reliable for conducting legal research. She emphasized that while these tools can generate responses that appear plausible, the information may often be incorrect or entirely fabricated.

Judge Sharp highlighted the necessity for lawyers to verify the accuracy of AI-generated information against trusted sources before using it professionally. The ruling arose after instances where lawyers had presented citations to cases that either did not exist or were inaccurately attributed. One lawyer, representing a claimant against two banks, included 45 citations, of which 18 were made up, leading to many unsupported assertions. In another case, a lawyer for a man evicted from his home cited five non-existent cases, though she denied using AI and suggested the issues might stem from AI-generated summaries she encountered on search engines.

The judge expressed concern that increasing occurrences of false citations tied to AI usage signal a pressing need for stronger measures to ensure compliance with duty to the court. She indicated that her ruling would be communicated to professional bodies, including the Bar Council and the Law Society.

Judge Sharp cautioned that lawyers failing to meet their professional obligations may face severe penalties, ranging from public admonitions to contempt proceedings, or even police referrals.
