Legal filings from OpenAI and Jony Ive’s startup, io, reveal details about their efforts to develop a mass-market AI hardware device amid a trademark dispute with iyO, a Google-backed startup. iyO is working on custom-molded earpieces designed to connect with various devices.
The complication arose when OpenAI withdrew promotional materials related to its $6.5 billion acquisition of io to comply with a court order regarding the lawsuit. OpenAI is contesting claims of trademark infringement made by iyO.
According to the lawsuit’s filings, OpenAI and io have engaged in extensive research on in-ear hardware technology over the past year. They have purchased numerous headphone sets to evaluate competitors in the market. Additionally, executives from both companies have had consultations with iyO’s leadership, showcasing their in-ear technology.
Interestingly, the initial product from this collaboration may not be a pair of headphones. Tang Tan, a co-founder of io, confirmed that the prototype referenced by OpenAI CEO Sam Altman is not an in-ear or wearable device, and the product’s design is not finalized. It is projected to take at least a year before any product becomes available for marketing.
While details about the product’s form are scant, Altman suggested in recent statements that they are working toward a range of AI devices with varied capabilities. It’s rumored that these devices could function as a third category alongside smartphones and laptops, hinting at a product that could utilize sophisticated environmental awareness features.

Tan’s firm has expressed disinterest in pursuing a custom-molded earpiece product, despite discussions from iyO about positioning its device as a developer kit for OpenAI’s eventual hardware launch. OpenAI appears to be over a year away from releasing its first device, indicating substantial research is still essential for determining the final design and functionality.
